Ark. Code Ann. § 18-15-406: Water pipelines and appurtenances

Water pipelines, with appurtenances, may be constructed and maintained: (1) Across and under lands and waters of the state, but the ordinary use of the lands and waters shall not be unduly obstructed thereby; and (2) (A) Under, across, and along public highways, roads, streets, and alleys. (B) However, the ordinary use of these public highways, roads, streets, and alleys shall not be unduly obstructed thereby, and the municipality constructing the water pipelines shall at its own expense properly backfill the trench in which the pipeline is laid and shall at its own expense restore any sidewalks, curbs, gutters, pavements, or surfacing cut or damaged by the construction or maintenance. Water pipelines, with appurtenances, may be constructed and maintained:
