(a) A qualifying project shall be developed only after the responsible public entity has issued a request for proposals or invitation for bids under § 22-10-202(a) . (b) (1) A private entity that intends to be considered for a qualifying project under subsection (a) of this section shall submit a proposal or bid to the responsible public entity. (2) A proposal by a private entity under subdivision (b)(1) of this section shall be accompanied by the materials and information required by the rules promulgated under this chapter. (c) A qualifying project shall: (1) Be located on real property owned or leased by a public entity; and (2) Include any improvements necessary or desirable to unimproved real property owned by a public entity.
