(a) It is unlawful for any person to commit Medicaid fraud as prohibited by § 5-55-111 . (b) Medicaid fraud is a: (1) Class C felony if the aggregate amount of payments illegally claimed is two thousand five hundred dollars ($2,500) or more but less than five thousand dollars ($5,000); (2) Class B felony if the aggregate amount of payments illegally claimed is five thousand dollars ($5,000) or more but less than twenty-five thousand dollars ($25,000); and (3) Class A felony if the aggregate amount of payments illegally claimed is twenty-five thousand dollars ($25,000) or more. (c) Otherwise, Medicaid fraud is a Class A misdemeanor. Amended by Act 2019, No. 916,§ 4, eff. 7/24/2019. Amended by Act 2017, No. 978,§ 3, eff. 8/1/2017. (b) Medicaid fraud is a: (1) Class C felony if the aggregate amount of payments illegally claimed is two thousand five hundred dollars ($2,500) or more but less than five thousand dollars ($5,000); (2) Class B felony if the aggregate amount of payments illegally claimed is five thousand dollars ($5,000) or more but less than twenty-five thousand dollars ($25,000); and (3) Class A felony if the aggregate amount of payments illegally claimed is twenty-five thousand dollars ($25,000) or more.
(1) Class C felony if the aggregate amount of payments illegally claimed is two thousand five hundred dollars ($2,500) or more but less than five thousand dollars ($5,000);
(2) Class B felony if the aggregate amount of payments illegally claimed is five thousand dollars ($5,000) or more but less than twenty-five thousand dollars ($25,000); and
(3) Class A felony if the aggregate amount of payments illegally claimed is twenty-five thousand dollars ($25,000) or more.
(c) Otherwise, Medicaid fraud is a Class A misdemeanor.
