C.R.S. § 22-29.5-112: Procedural safeguards.

A local education provider shall establish and implement, with respect to actions regarding the identification, evaluation, or educational placement of a student who may have a disability, a system of procedural safeguards that includes notice of the proposed identification, evaluation determination, or educational placement decision, an opportunity for a parent of the student to examine relevant records, an impartial hearing with opportunity for participation by the student's parent and representation by legal counsel, and an opportunity to appeal an impartial hearing outcome. Compliance with the procedural safeguards of the IDEA is one means of meeting this requirement.
