D.C. Code § 3-1205.14a: Negotiated settlement agreement.

(a)

A board may, in its discretion, enter into a non-disciplinary settlement agreement with a person in lieu of disciplinary action; provided, that the conduct underlying the agreement meets the following requirements:

(1)

The board is satisfied that there is little or no harm or substantive possibility of future harm to a client, patient, or the public;

(2)

The board determines that the conduct involves issues of minor concern; and

(3)

The matter does not involve gross negligence, intentional misconduct, or criminal conduct by the party or entity.

(b)

A non-disciplinary settlement agreement shall not constitute a disciplinary action, but the conduct underlying the agreement may be considered in the board's review of future conduct of a similar nature.
