D.C. Code § 31-3875.08: Failure to comply and penalties.

(a)

Any failure by a utilization review entity to comply with the requirements specified in this chapter shall result in the health care service in question being deemed approved.

(b)

An action by a utilization review entity that establishes a pattern or practice of repeated violations of this chapter, as determined by the Commissioner of the Department of Insurance and Securities Regulation, shall constitute a violation of Chapter 22A of this title.
