(a)

(1)

An AV testing entity that violates Chapter 23A of Title 50, or a regulation promulgated pursuant to Chapter 23A of Title 50, shall be subject to a civil penalty of not more than $1,000 per offense.

(2)

Each day of a violation of Chapter 23A of Title 50, or a regulation promulgated pursuant to Chapter 23A of Title 50, shall constitute a separate offense, and the penalties set forth in this subsection shall be applicable to each separate offense.

(b)

In addition to, or in lieu of, the civil penalty described in subsection (a) of this section, the Department may modify, suspend, revoke, or deny an AV testing permit issued by the Department for a violation of Chapter 23A of Title 50, or a regulation promulgated pursuant to Chapter 23A of Title 50, after notice and opportunity for a hearing pursuant to § 50-2352.07.
