O.C.G.A. § 33-24-16.1: Clarification of term “actual charge” or “actual fee”.

(a) The term “actual charge” or “actual fee,” when used in an individual or group specified disease insurance policy, shall mean the amount actually paid by or on behalf of an insured person and accepted as full payment by a health care provider or other designated person for the goods or services provided.

(b) The General Assembly finds and declares that the provisions of subsection (a) of this Code section are intended to clarify the correct interpretation of the defined terms for instances in which the particular insurance policy does not otherwise contain a definition.
