4 GCA § 6225.2: Hazardous Pay for Mayors’ Council of Guam Personnel.

(a) Notwithstanding § 304 of Article 3, Chapter 6, Title 4, Guam Code Annotated, the Civil Service Commission Hazardous/Environmental Pay Policy and Procedures, or any other provision of law, rule, regulation, and Executive Order, the personnel of the Mayors’ Council of Guam working in what are deemed hazardous duty working conditions or duty involving physical hardship (environmental) shall be entitled to a ten percent (10%) hazardous pay differential and the Mayors’ Council of Guam shall identify the direct-exposure personnel and ensure that all affected personnel receive the hazardous pay differential. The Mayors’ Council of Guam shall additionally develop protocol for personnel not normally in direct-exposure situations for those times when they are in unusual and dangerous direct contact situations, at which time they shall then be entitled to a hazardous pay differential for that specific incident in which they were exposed, including, but not limited to, exposure to dangerous conditions in preparation for, during, and following typhoons and other natural disasters and during periods of a declaration of emergency.

(b) For the purposes of this Section, the following definitions shall apply:

(1) Duty Involving Physical Hardship (Environmental): Duty that may not in itself be hazardous but causes extreme physical discomfort or distress and is not adequately alleviated by protective or mechanical devices, such as duty involving exposure to extreme temperatures for a long period of time, arduous physical exertion, or exposure to fumes or dust or noise that causes nausea, skin, eye, or nose irritation, or noise irritation that would cause undue duress.

(2) Hazardous Duty: A duty performed under circumstances in which an accident could result in serious injury or death. Any injuries incurred while working under unsafe conditions should be considered as well and not just based on severity or death.

(3) Natural Disasters: Working in a hazardous environment such as high velocity winds in excess of eighteen (18) knots or twenty-one miles per hour (21 MPH), darkness and unsafe structure; and exposing employees to hazard duties such as evacuation, search and rescue, and damage assessment efforts.
