The Attorney General, or his assistants under his direction, shall appear for the defense and protection of the interests of the State of Illinois in all cases filed in the court, and may make claim for recoupment by the State.

The Attorney General, or his or her assistants under his or her direction, shall appear for the defense and protection of the interests of the State of Illinois in all cases filed in the court, and may make claim for recoupment by the State. Except as provided in Section 8.2, for all claims arising under subsection (b) of Section 8 of this Act that are from lapsed appropriations and are equal to or greater than $2,500:
(1) the State agency must confirm, reject, or identify a defect within the claim in writing with the Attorney General's office within 90 calendar days of being contacted by the Attorney General; and
(2) the Attorney General must file a stipulation or motion with the Court within 90 calendar days of the State agency confirming or rejecting the claim.
