KRS 146.490: Custody of nature preserve.

  1. KRS Chapter 146

An owner of an area which is dedicated as a nature preserve may retain custody thereof,

or may designate a custodian, subject to the rules and regulations of the office. If the

owner or custodian declines, is unable, or fails to administer and manage the nature

preserve in accordance with the articles of dedication, the office shall undertake such

custodial functions as may be necessary for the protection, maintenance, and use of the

nature preserve until the disability is removed. Whenever feasible, and consistent with the

articles of dedication, the office shall vest custody of a nature preserve in the former

owner, a private organization or an individual.
