create positions -- Election of coverage under unemployment insurance.

(1) The secretary shall, subject to the provisions of KRS Chapter 12, establish the

internal organization of the offices and departments not established in 1974 Ky.

Acts ch. 74, Art. VI, or 1998 Ky. Acts ch. 426, and shall organize the cabinet into

offices, divisions, regions, districts, and other administrative units as the secretary

deems necessary to perform the functions, exercise the powers, and fulfill the duties

of the cabinet.

(2) The secretary shall have any and all necessary powers and authority subject to

appropriate provisions of the statutes to create positions that enable the cabinet to

fulfill all functions assigned to it. The secretary shall designate a person to act as

deputy to exercise the duties of the office in case of absence.

(3) The secretary shall, with the approval of the Governor, elect coverage for employees

of the cabinet under the unemployment insurance law when required by federal law.
