If a proposed site fails to meet the criteria established by the cabinet for a septic tank

system, a permit shall be granted for an approved on -site sewage disposal system ot her

than a septic tank, including modified subsurface systems, mechanical systems, and any

other system appropriate to the individual characteristics of the site which will provide

sewage treatment that meets established water quality criteria and health standards.
