KRS 212.060: When fiscal court may not establish.

When a county by a vote of its citizens, as provided in KRS 212.070 to 212.110, shall

vote against creating, establishing and maintaining a county department of health, the

department of health may not be created, established or maintained by resolution of its

fiscal court until after the expiration of the terms of office of the members of the fiscal

court who were members of the court when the election was held.
