KRS 286.13-070: Administrative regulations -- Determination of nonrefundable fees.

(Effective April 30, 2027)

(1) Subject to subsection (2) of this section, the commissioner shall promulgate

administrative regulations in accordance with KRS Chapter 13A to establish:

(a) The format of, and manner of submission for, applications, notices, and

reports required under this subtitle;

(b) The nonrefundable application fees required under KRS 286.13 -035 and

286.13-045;

(c) The nonrefundable annual renewal fee required under KRS 286.13-060;

(d) Any additional information, documentation, or evidence that the

commissioner may require under KRS 286.13-040; and

(e) The information, documentation, and evidence that shall be contained in or

accompany an application or notice filed under KRS 286.13 -045 or 286.13 -

065.

(2) (a) The nonrefundable fees required under KRS 286.13 -035, 286.13 -045, and

286.13-060 shall be determined based on a reasonable estimation of the

amount required to cover the reasonable costs to the department to:

1. Review, investigate, and process the relevant applications and reports;

and

2. Enforce the requirements of this subtitle.

(b) The determination made under paragraph (a) of this subsection shall take into

account any other costs, fees, and expenses that are otherwise payable to the

commissioner under this subtitle.
