KRS 304.13-420: Financial responsibility requirement.

No insurer shall be required to offer a deductible to an employer policyholder, as

provided in KRS 304.13 -400, if the insurer determines, subject to review by the

commissioner, that the prospective employer policyholder is not financially able to

comply with the terms and conditions of a deductible workers' compensation policy.
