KRS 353.433: Ownership and control of carbon dioxide -- Liability.

  1. KRS Chapter 353

The sequestration operator shall be the owner of the carbon dioxide injected into and

stored in a sequestration reservoir approved under KRS 353.411 to 353.459 and shall

maintain ownership and control until the cabinet issues a completion certificate. Whil e

the sequestration operator has ownership, the sequestration operator is liable for any

damage the carbon dioxide may cause, including damage caused by carbon dioxide that

escapes from the sequestration facility.
