KRS 393.200: State Treasurer may perform duties of county attorney.

If the county attorney declines to perform the duties imposed upon him by this chapter,

they may be performed by the State Treasurer. When he considers it to the best interest of

the state, the State Treasurer may institute any action authorized by this ch apter to be

brought by the county attorney, or join the county attorney in the active prosecution of the

action.
