(1) Every fiduciary, before entering upon the execution of the trust, shall receive letters
of appointment from the District Court having jurisdiction as fixed by law.
(2) The duties of a fiduciary shall be those required by law, and any additional duties as
the court may order.
(3) The appointment of the personal representative shall be effective upon the signing
of an order by the judge, the presenta tion to the clerk of an executed surety bond
when required under KRS 395.130, and either the administration of any oaths
required in KRS 395.120, or the filing of the declaration in KRS 395.120 if no
hearing is required.
