KRS 416.010: Institution of condemnation action by railroad.

When any company authorized to construct a railroad is unable to contract with the owner

of any land or material necessary for its use for the purpose thereof, it shall institute a

condemnation action pursuant to the Eminent Domain Act of Kentucky.
