KRS 69.090: When assistants shall act as Commonwealth's attorney.

In the absence of the Commonwealth's attorney, the first assistant Commonwealth's

attorney shall act as Commonwealth's attorney, without additional compensation. In the

absence of both the Commonwealth's attorney and the first assistant Commonwealth's

attorney, the second assistant Commonwealth's attorney shall act as Commonwealth's

attorney, without additional compensation.
