Mass. Gen. Laws ch. 161, § 106: Assumption of risk

Section 106. No company shall by rule or otherwise require passengers whom it permits to ride upon the platform to do so at their own risk, and no such passenger shall be prevented from recovering compensation in damages for any injury by reason of the fact that he is so riding.
