Mass. Gen. Laws ch. 200, § 4: Fees and costs

Section 4. If the petition is dismissed, the fees and cost of publishing, serving and recording said notice shall be paid by the petitioner; if a receiver is appointed they shall be paid by the receiver and allowed in his account.
