Mass. Gen. Laws ch. 271, § 41: Offices not public offices under Sec. 40

Section 41. The offices of probation officer, notary public, justice of the peace, prison officer, agent of the commissioner of correction and agent of the department of public welfare shall not be considered public offices within the meaning of the preceding section.
