27-28-104: Upon whose relation action brought -- security for costs.

The officer may, upon the officer's own relation, bring any action, or the officer may, on leave of the court or a judge in vacation, bring the action upon the relation of another person. If the action is brought under 27-28-101(1), security for costs may be required, to be given as in other cases.
