N.C. Gen. Stat. § 126A-5-9: Lateral transfers.

Notwithstanding the posting requirements of G.S. 126A-5-2, based on its business or operational needs, an agency may transfer an existing employee into a vacant position with the same classification at an equal or higher salary at the agency with the consent of the employee. Employees in supervisory positions may be transferred pursuant to this section only if the employee is not a career employee or the transfer is to another supervisory position. (2026-40, s. 1.)
