10. a. The Department of Agriculture shall adopt, pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), rules and regulations concerning the enforcement of the prohibitions on the sale, distribution, export, import, and propagation of invasive plant species as it pertains to their regulation of plant growers and dealers, or as otherwise necessary to effectuate the provisions of this act.
b. The Department of Agriculture may impose fees to cover its enforcement and inspection costs incurred in implementing the provisions of this act. All fees collected under this act shall be paid into the State treasury and shall be appropriated to the Department of Agriculture for use in implementing the provisions of this act.
