N.J. Stat. § 26:2H-18.57a: Federal Medicaid plan amendment or waiver requirement.

2. If a federal Medicaid plan amendment is required to effectuate the assessment on ambulatory care facilities in the manner provided in paragraph (7) of subsection b. of section 7 of P.L.1992, c.160 (C.26:2H-18.57) or if a waiver is required pursuant to 42 C.F.R. s.433.68, the Commissioner of Human Services shall apply to the federal Centers for Medicare and Medicaid Services for a State plan amendment or a waiver, as applicable, and shall receive approval prior to implementing the assessment on ambulatory care facilities.
