1. If a patient in a division facility is transferred to another division facility or to a medical facility, a facility for the dependent, an agency to provide personal care services in the home or a physician licensed to practice medicine, the division facility shall forward a copy of the medical records of the patient, on or before the date the patient is transferred, to the facility, agency or physician. Except as otherwise required by 42 U.S.C. § 290dd, 290dd-1 or 290dd-2 or NRS 439.591 or 439.597, the division facility is not required to obtain the oral or written consent of the patient to forward a copy of the medical records.

2. As used in this section:

(a) “Agency to provide personal care services in the home” has the meaning ascribed to it in NRS 449B.015.

(b) “Medical records” includes a medical history of the patient, a summary of the current physical condition of the patient and a discharge summary which contains the information necessary for the proper treatment of the patient.
