N.Y. Correction Law § 861: Incarcerated individual not agent of state

§ 861. Incarcerated individual not agent of state. An incarcerated

individual participating in a work release program shall not, merely by

reason of such participation, be deemed an agent, employee or servant of

the state while outside the premises of an institution pursuant to the

terms of a work release program.
