N.Y. Economic Development Law § 102: Atomic energy council

§ 102. Atomic energy council. 1. There shall be within the department,

the atomic energy council (hereinafter sometimes referred to as the

"council"), which shall consist of the commissioner and such other

representatives of state departments, agencies and instrumentalities

importantly concerned with atomic energy and such other persons as the

governor may from time to time designate who shall serve at the pleasure

of the governor.

2. Each member of the council may, by official order filed with the

council, designate a deputy, who, in the case of a member who is an

official of the state, any instrumentality, agency or subdivision

thereof, shall be an officer of his department, commission or public

benefit corporation, to perform his duties under this article. The

designation of such deputy shall be deemed temporary only and shall not

affect the civil service or retirement rights of any person so

designated.

3. The members of the council and their respective deputies, if any,

shall serve without compensation, but each of them shall be entitled to

reimbursement for his actual and necessary expenses incurred in the

performance of his official duties.

4. The commissioner shall serve as chairman of the council and may

appoint such subordinates and employees as may be necessary to carry out

the duties imposed upon the council by law. At any meeting or proceeding

not attended by the chairman, the council shall elect an acting

chairman. Legal, technical, scientific, engineering and other services

for the council, other than those performed by employees of the council,

shall be performed by personnel of the department, the state departments

of health and labor, or other departments or agencies of the state.
