§ 27-0706. Closure requirements for certain landfills and recycling

requirements for certain municipalities.

1. For the purpose of this section the term "landfill" shall have the

same meaning as such term is defined in subdivision twelve of section

27-0901 of this article.

2. a. This section shall apply to all landfills that:

(i) operated during nineteen hundred ninety-five;

(ii) did not have a valid permit to operate pursuant to this article

during such year; and

(iii) accepted for disposal an average of more than eight thousand

tons per day of solid waste during such year.

b. Notwithstanding any provision of law or order to the contrary, no

landfill covered by this section shall accept solid waste for disposal

after January first, two thousand two.
