N.Y. Environmental Conservation Law § 27-3317: Penalties

§ 27-3317. Penalties.

Any producer, representative organization, or retailer who violates

any provision of or fails to perform any duty imposed pursuant to this

title shall be liable for a civil penalty not to exceed five hundred

dollars for each violation and an additional penalty of not more than

five hundred dollars for each day during which such violation continues.

Civil penalties shall be assessed by the department after a hearing or

opportunity to be heard pursuant to the provisions of section 71-1709 of

this chapter.
