N.Y. Environmental Conservation Law § 53-0307: Funding of department; municipal authorization for local urban forestry and arboriculture programs

§ 53-0307. Funding of department; municipal authorization for local

urban forestry and arboriculture programs.

In the absence of federal legislation funding the department's

participation under section 53-0305, no duty is imposed on the

department hereunder. Federal funding, however, is not a prerequisite to

local implementation of municipal urban forestry or arboriculture

programs, as herein provided; and any municipality may implement a local

urban forestry or arboriculture program within its jurisdiction under

the authority of this title and chapter. All charges and expenses

incurred under this section by a town shall be a charge upon the taxable

property of that part of the town outside any incorporated village.
