N.Y. Military Law § 130.7: Apprehension

§ 130.7. Apprehension. (a) Apprehension is the taking into custody

of a person.

(b) Any person authorized under regulations issued pursuant to this

chapter to apprehend persons subject to this code, any marshal of a

court-martial appointed pursuant to the provisions of this chapter and

any peace officer, acting pursuant to his special duties, or police

officer may apprehend persons subject to this code upon reasonable

belief that an offense has been committed and that the person

apprehended committed it.

(c) All officers, warrant officers, petty officers, and

non-commissioned officers shall have authority to quell all quarrels,

frays, and disorders among persons subject to this code and to apprehend

persons subject to this code who take part in the same.

(d) Except as otherwise specifically provided in this chapter, no

peace officer, police officer or marshal of a court-martial shall demand

or require payment of any fee or charge of any nature for apprehending

or placing in confinement any person subject to this code.
