N.Y. Public Health Law § 1152: Annual water supply statement; delivery

§ 1152. Annual water supply statement; delivery. 1. Each water works

corporation shall provide a water supply statement to its customers

annually. The annual water supply statement shall either be mailed to

each customer or published in at least one newspaper of general

circulation in the area served by the water works corporation. If the

statement is to be published in a newspaper, the water works corporation

shall provide ample notification by announcing the publication date and

newspaper name either on the customers bill or in the newspaper in which

the statement shall appear. A limited number of additional copies, in a

quantity to be determined by the water works corporation, shall be

provided to customers upon request. In addition, the statement must be

posted on the water works corporation's website, if such exists, or be

made available to the municipality or municipalities in which the water

works corporation services to be posted on such municipalities' website,

if such exists.

2. Each water works corporation shall also provide one copy of each

annual water supply statement to the commissioner and the state

commissioner of environmental conservation.

3. The annual water supply statement shall be mailed or published, and

posted online on or before the thirty-first day of May of each year and

shall apply to data received by the water works corporation during the

preceding calendar year.

4. The information required by subdivision four of section eleven

hundred fifty-one of this title for each source of water may be placed

in a supplement to the annual water supply statement instead of in the

main body of the statement; provided that:

(1) the statement provides such information for a representative

sampling of distribution point samples and a notice to the effect that

such information for each source of water is included in a supplement

available to each customer upon request from the water works

corporation; and

(2) the supplement is included in each copy of the water supply

statement provided to customers upon request under subdivision one of

this section and provided to commissioners under subdivision two of this

section; and

(3) the supplement shall be

(i) published in a notice at least one-half page in size, in one

newspaper of general circulation within the water district; or

(ii) made available on a public electronic bulletin board, along with

the supplements from the two prior years, if such prior supplements

exist, and notice of the availability of such information on a public

electronic bulletin board shall be clearly provided on each billing

statement and shall be published in a newspaper of general circulation

within the water district; or

(iii) made available at all New York state documents information

access centers, documents reference centers, documents depository

libraries and documents research depository libraries within the water

district and if no such libraries exist within the water district, at a

public library within the water district, and notice of the availability

of the supplement at such library of libraries shall be clearly provided

on each billing statement and shall be published in a newspaper of

general circulation within the water district.

Such supplement need not be included in the copy of the annual water

supply statement mailed to each customer or published under subdivision

one of this section.
