The commissioner shall promulgate rules classifying each violation of applicable affordable housing provisions as a major violation or a minor violation. Such classification of violations shall be based upon, but not limited to, such factors as the effect of the violation on neighborhood economic diversity, the public interest or the necessity for economic disincentives.
