N.Y.C. Admin. Code § BC U204: Section BC U204: ADU Detached from the Primary Dwelling

U204.1 Scope.

An ADU detached from the primary dwelling shall be constructed in accordance with the New York City Zoning Resolution and all requirements of Group R-3 occupancy in this code, except as provided by Section U103, Sections U203.2 and U203.4 through U203.7, and Section U204.2.

U204.1.1 Occupancy classification.

Where the ADU is detached from the primary dwelling, both the ADU and the primary dwelling unit shall be classified as Group R-3 occupancy and shall comply with all applicable requirements of Group R-3 occupancy in this code.

U204.2 Egress arrangement.

The ADU shall provide all vertical circulation and exit systems required by this code without entering the primary dwelling. The construction of an ADU shall not alter the egress requirements for the primary dwelling pursuant to Chapter 10.
