A Local Law to amend the administrative code of the city of New York, in relation to extending the moratorium on the conversion, alteration or demolition of single room occupancy multiple dwellings and prohibiting withdrawal of single room occupancy dwelling units from the rental market during the moratorium

Be it enacted by the Council as follows:

Section 1. Declaration of legislative findings and intent. Local law fifty-nine of nineteen hundred eighty-five provided for a moratorium on the conversion, alteration and demolition of single room occupancy multiple dwellings and for the preparation of a report on the best means of making available single room occupancy and other low cost housing for low income persons. The council finds that the serious public emergency declared in such local law continues to exist and that it is necessary to continue the moratorium beyond the expiration date established in such local law so that city agencies and the council will have sufficient time to consider the recommendations of the report and to adopt and implement a program through appropriate legislative and administrative action. The Council further finds that prior to and during the moratorium there has been widespread withdrawal of single room occupancy dwelling units from the rental market, which has further reduced an already inadequate supply of such units; that this practice has contributed to the increasing homeless population; and that in order to further the objectives of local law fifty-nine and to maintain the availability of single room occupancy dwelling units for low income persons during the serious public emergency declared in such local law, it is necessary and in the public interest to prevent owners from warehousing single room occupancy dwelling units during the moratorium.

§ 2. Section six of local law number fifty-nine of nineteen hundred eighty-five is amended to read as follows:

§ 6. This local law shall take effect immediately and shall be retroactive to and shall be deemed to have been in full force and effect on and after January ninth, nineteen hundred eighty-five. Subdivisions a and c of section C26-118.10 of the administrative code, as added by section two of this local law, shall cease to have any force or effect and shall terminate [eighteen months after such effective date] on December thirty-first nineteen hundred eighty-six, unless terminated prior to such date by local law.

§ 7. Subdivisions a and c of section 27-198.2 of the administrative code of the city of New York, as added by a chapter of the laws of nineteen hundred eighty-six entitled "AN ACT to amend the administrative code of the city of New York, in relation to making certain technical corrections, changes and conforming amendments made necessary by the recodification of such code and amendments by the state legislature and city council of the city of New York in the year nineteen hundred eighty-five and to repeal certain provisions of such code relating thereto and to amend chapter nine hundred seven of the laws of nineteen hundred eighty-five, relating to the recodification of the administrative code of the city of New York in relation to allowing citation of the sections of the code by their former numbers", shall cease to have any force or effect and shall terminate on December thirty-first nineteen hundred eighty-six, unless terminated prior to such date by local law.

§ 8. If any provision of this local law or its application to any person or circumstance shall be held invalid, the remainder of this local law and the applicability of its provisions to other persons or circumstances shall not be affected thereby.

§ 9. This local law shall take effect immediately.
