Ohio Rev. Code § 5119.141: Authority of department.

In addition to the powers and duties expressly conferred on the department of behavioral health, the department may take any other action it considers necessary to carry out the purposes of this chapter and Chapters 340., 2919., 2945., and 5122. of the Revised Code. Actions authorized by this section include the authority to adopt rules pursuant to Chapter 119. of the Revised Code that may be necessary to carry out the purposes of this chapter and Chapters 340., 2919., 2945., and 5122. of the Revised Code.
