influence of intoxicant - Penalties.

The owner or operator of an aircraft or the person in charge or

in control of an aircraft shall not knowingly permit the aircraft to

be operated within this state by a person who is under the influence

of any intoxicant. A person who is convicted of violating this

section shall be guilty of a misdemeanor, punishable by imprisonment

for not more than six (6) months, or a fine of not less than One

Hundred Dollars ($100.00) nor more than Five Hundred Dollars

($500.00), or both such fine and incarceration.
