(1) A small producer is exempt from the requirement to be a member of a producer responsibility organization under ORS 459A.869.
(2) The Environmental Quality Commission may adopt rules to exempt from the requirements of ORS 459A.869 producers that do not exceed a minimum market share of covered products sold in or into this state.
