SDCL § 25-4A-37: Appointment upon consent of parties.

Any person not meeting the educational requirements of subdivision 25-4A-36(5) may be appointed as a custody evaluator upon consent of the parties, and order approving the same at the court’s discretion. The person is still required to comply with the training requirements of subdivisions 25-4A-36(2), (3) and (4).

Commission Note: By order dated June 3, 2026, the Supreme Court delayed the effective date of Rule 26-07 from July 1, 2026, to December 31, 2026.
