SDCL § 43-17-4: Opposite banks of nonnavigable stream belonging to different persons--Stream and bed common to both.

CHAPTER 43-17. WATER BOUNDARIES AND RIPARIAN LANDS

In all cases where the opposite banks of any streams not navigable belong to different persons, the stream and the bed thereof shall become common to both.
