SDCL § 9-14-37: Neglect of duty or misconduct--Penalty--Removal.

It is a Class 2 misdemeanor for any elected or appointed officer or employee to commit a palpable omission of duty or to intentionally commit oppression, misconduct, or malfeasance in the discharge of official duties. Upon conviction of a violation of this section, the court may enter an order removing the convicted elected or appointed officer or employee from the municipal office or position.
