(a) No person shall stand in a roadway for the purpose of soliciting a ride or employment from the occupant of any vehicle. (b) No person shall stand on or in proximity to a street or highway for the purpose of soliciting the watching or guarding of any vehicle while parked or about to be parked on a street or highway. (c) No person shall loiter or conduct any commercial activity in, or in proximity to, the median of a state highway. (d) Subsection (c) does not apply to: (1) Employees of, or agents, contractors, or other persons under contract with, or acting on behalf of, the department of transportation; and (2) Employees of, or agents, contractors, or other persons who are under contract with, or acting on behalf of, a county, municipality, or other political subdivision of this state or a utility, and who are permitted by the department of transportation to stand or conduct any activity in, or in proximity to, the median of a state highway. (e) A violation of this section is a Class C misdemeanor; except, that a person who violates subsection (c) shall receive a warning citation for a first offense. Amended by 2019 Tenn.
