Tex. Government Code § 2156.061: USE OF OPEN MARKET PURCHASE PROCEDURE.

On a comptroller determination that a purchase of goods or services may be made most effectively in the open market, the comptroller may use the open market purchase procedure and the purchase may be made without newspaper advertising.
