Except as provided by Section 1702.104, an insurer may not, with respect to a life insurance policy or annuity contract, make or permit a distinction or unfair discrimination between individuals of the same class and equal life expectancy regarding:
(1) the rate charged;
(2) the dividend or other payable benefit; or
(3) any of the other terms of the policy or contract.
