Tex. Local Government Code § 552.091: APPLICATION OF SUBCHAPTER TO CERTAIN MUNICIPALITIES.

To exercise authority under this subchapter, a municipality must have:

(1) a population of less than 15,000;

(2) levied the maximum rate of tax allowed by law; and

(3) adopted Subchapters A through C, Chapter 312, Transportation Code.
