  5. SUBCHAPTER B. ADMINISTRATIVE PENALTY

(a) The commission may assess an administrative penalty under this subchapter in an amount not to exceed $10,000 for each violation.

(b) In determining the amount of the penalty, the commission shall consider the seriousness of the violation.
